TERMS & CONDITIONS


This is a binding contract between Wines of South Africa (WOSA) and the exhibitor. The exhibitor hereby agrees to adhere to the standard terms and conditions set by the Cape Town International Convention Centre (CTICC) and in the Cape Wine exhibitor manual.  The exhibitor is fully liable should they not comply accordingly to these afore mentioned terms and conditions. Standard Terms and Conditions can be provided on request. No other contract, warranties, particulars of variations, oral or written, shall be binding on WOSA. Failure to attend, pay timeously or otherwise can result in cancellation and payment of consequential damages in terms of the Standard Terms and Conditions of Lease, which the exhibitor acknowledges forms part of the offer.

WOSA shall not be held liable or responsible to any party for any claim, damage or loss caused to any person as a result of WOSA or any of its employees, representatives or assigns failure to comply, or to comply timeously, with any provision/s of the contract of hire.

WOSA shall not be held responsible for the safekeeping, storage, use or otherwise of any property brought into the CTICC. Property belonging to the exhibitor or third parties shall be brought into the CTICC at their own risk and the exhibitor indemnifies WOSA of any risk thereof.

Producer wines that are displayed and /or dispensed at any Wines of South Africa exhibitions shall be limited to wine, as per the definition of wine in the Liquor products Act.

WOSA shall not be held liable for any loss, injury or damage, howsoever caused, to goods and/or persons in the CTICC and/or on adjacent sites.

WOSA shall not be held liable for the failure to perform any of its respective obligations under this agreement due to any cause beyond the control of the parties or any fire, earthquake, flood, epidemic, accident, explosion, casualty, strike, riot, lock out, civil disturbances, act of public enemy, embargo, war, acts of God, the making of any municipal, state or federal law or ordinance by any legally constituted authority, or the issue of any executive or judicial order, provided that in the event (or in the event it becomes apparent) that the Cape Wine event will not be held due to any such reason.

WOSA reserves the right to modify these Terms of Service at any time. We do so by posting and drawing attention to the updated terms on the Cape Wine website. Your decision to continue to visit and make use of the Cape Wine website after such changes have been made constitutes your formal acceptance of the new Terms of Service.

DEFAULT BY AN EXHIBITOR - Cancellation or reduction of a Cape Wine booking

In the event of default by a company whose application has been accepted and artwork not finalised before the 30th April full payment of the stand shall be refunded to the exhibitor.  Should cancellation of stand space occur after 30th April 2015 10% of the stand cost will remain the property of Wines of South Africa, who may dispose of the site left vacant as it sees fit. The balance of the fee paid for the stand will be refunded to the defaulting company.  Should the artwork of the defaulting company have been signed off and the Xanita stand printed, irrelevant of the date, then the defaulting company is liable for the full 100% cost of the stand when selecting to cancel their Cape Wine booking.

 

If customised stand space is reduced before the 30th April 2015 there will be no charge thereafter 10% charge will be made on the cost of the space reduced.
